Mr. Mazow:

I am a partner with Dr. Kort in his real estate holdings and in various educational, professional, and charitable projects.

Dr. Kort has kept me constantly informed of the details of his complaint that Bedfordshire has wrongfully assessed condominium fees to develop and maintain the golf course upon the open space, wetlands and town-owned conservation lands.

I have read the law, and I understand that Bedfordshire has violated it. Bedfordshire has usurped conservation lands which it does not own and developed golf holes on them; it has pumped water from the Shawsheen River, in water-poor Bedford, without approval from or compensation to the town; and perhaps most egregiously it has developed these golf holes outside of the normal democratic processes stipulated by the state law which governs proper condominium management. Bedfordshire has shown no respect for state and local environmental laws which protect wetlands areas.

Dr. Kort, is of course quite right to protest. In fact, his protest blows the whistle on the Board's shamefully illegal mode of governance. In reaction, the Board sues the herald of bad news, a classic, and classically erroneous response.

You have an obligation to manage correctly and lawfully. You should drop this feckless lawsuit and resolve the issue by proper democratic processes within the community.
